Terms of service
The agreement between your organisation and GHIJK Ltd when you use Arku to advertise jobs and manage applications.
- Version
- 0.1
- Effective
- What changed
- First draft for legal review.
These terms are an agreement between GHIJK Ltd, a company registered in New Zealand ("we", "us"), and the organisation that creates an Arku account ("you"). The person who accepts these terms confirms that they are allowed to do so for that organisation. Arku is a tool for businesses and not-for-profits. It is not offered to consumers.
1. The service
Arku lets you publish jobs on a careers page, receive applications, move candidates through a hiring pipeline, score and discuss them as a team, and contact them by email and text message. The features available depend on your plan, which is described on our pricing page.
Arku never ranks, scores or recommends candidates automatically. Every hiring decision is made by people in your organisation, and you are responsible for those decisions.
2. Your account
- You must give accurate details about your organisation and keep them up to date.
- You must verify your email address before you publish a job. Accounts created with a free email address are reviewed before their jobs can be published.
- You are responsible for everyone you invite to your account, for the roles you give them and for keeping sign in details secure. Tell us straight away at hello@arkuhq.com if you think your account has been misused.
3. Plans, billing and tax
Paid plans are sold through Paddle.com, which acts as our merchant of record. Paddle processes your payment, charges any sales tax, GST or VAT that applies and issues your invoices, under its own buyer terms. Prices on our website exclude tax.
Paid plans renew automatically each month or year until you cancel. We may change our prices by giving you at least 30 days' notice by email. A change applies from your next renewal after the notice period. Cancellation, pausing and refunds are covered in our refunds and cancellation policy.
Not-for-profit discounts are available to organisations that are registered charities or not-for-profits in their country. We may ask for evidence and may remove the discount if the organisation is not eligible.
4. Your content and candidate data
You own the jobs, messages and other content you put into Arku, and the information candidates send you. You give us permission to host, copy and display that content only as needed to run Arku for you.
For candidate and team information, you are the controller (or "agency" in New Zealand) and we act as your processor. Our data processing agreement forms part of these terms and explains how we handle that information. All Arku data is stored in the United Kingdom.
You are responsible for having a lawful basis to collect and use candidate information, for giving candidates a privacy statement and for responding to their requests. Arku helps by recording consent, anonymising candidates after your retention period and letting you export or erase a candidate's data.
5. Acceptable use
You must follow our acceptable use policy.
In particular you must only advertise real jobs, must not ask candidates for bank details or government identity numbers, and must have a candidate's consent before texting them where the law requires it. We may remove content, unpublish jobs or suspend an account that breaks the policy, and we will tell you why unless the law or the safety of candidates prevents it.
6. AI features
On the Pro plan, Arku can draft job ads and messages, and can turn a question about your pipeline into a search. AI output is labelled, can be edited, and is only a draft: you are responsible for what you publish or send. AI features never read, summarise or evaluate candidate applications.
7. Availability and support
We work hard to keep Arku available and secure, but we do not promise that it will be uninterrupted or error free. We may change or improve features. If we remove a major feature you pay for, we will give you reasonable notice.
8. Ending the agreement
You can close your account at any time. We may end these terms or suspend your account if you seriously or repeatedly break them, if you do not pay, or if we stop offering Arku, in which case we will give you at least 60 days' notice and a way to export your data.
After your account closes, we delete or anonymise your organisation's data within 90 days, apart from records we must keep by law, such as billing records.
9. Liability
Nothing in these terms limits liability that cannot be limited by law.
Otherwise, neither party is liable for indirect or consequential loss, or for loss of profit or opportunity, and each party's total liability under these terms in any 12 month period is limited to the amount you paid us in that period.
Because Arku is supplied for business purposes, the guarantees in the New Zealand Consumer Guarantees Act 1993 do not apply, to the extent the law allows. If you are in Australia, nothing in these terms excludes rights you have under the Australian Consumer Law.
10. Changes to these terms
We may update these terms. We will email account owners at least 30 days before a change that reduces your rights takes effect. The current version and its effective date are always shown on this page.
11. Governing law
These terms are governed by the laws of New Zealand, and the courts of New Zealand have jurisdiction. This does not take away any right you have to bring a claim in the courts of the country where your organisation is based.
